To provide an occupant protection device capable of suppressing a seating state which makes appropriately performing impact absorption by an airbag and binding by a belt possibly difficult, due to that the inferior limb of an occupant moves forward at collision, regardless of a seating state of an occupant.SOLUTION: An occupant protection device includes: a seat; driving means capable of driving upward inside the seat; first detection means for detecting collision or collision possibility of a vehicle; second detection means for detecting a seating state of an occupant; and control means for controlling drive of the driving means. The driving means can displace a drive position, and the control means determines a first drive position on the basis of a seating state of the occupant when collision or collision possibility of the vehicle is detected, and controls so as to displace the drive position of the driving means to the first drive position in a state of driving the driving means upward in a second drive position different from the determined first drive position.SELECTED DRAWING: Figure 2

【課題】衝突時に乗員の下肢が前方に移動することでエアバッグによる衝撃吸収、ベルトによる拘束を適切に行うことが困難に成り得る着座状態になることを、乗員の着座状態によらずに抑制可能な乗員保護装置を提供すること。【解決手段】シートと、シート内部において上方に向って駆動することが可能な駆動手段と、車両の衝突又は衝突可能性を検知する第１検知手段と、乗員の着座状態を検知する第２検知手段と、駆動手段の駆動を制御する制御手段と、を備え、駆動手段は、駆動位置を変位させることが可能であり、制御手段は、車両の衝突又は衝突可能性が検知されると、乗員の着座状態に基づいて第１駆動位置を決定すると共に、決定された第１駆動位置とは異なる第２駆動位置において駆動手段を上方に駆動させた状態で、第１駆動位置に向かって駆動手段の駆動位置を変位させる制御を行う、乗員保護装置。【選択図】図２
